I, the participant (hereafter referred to as “Participant”), agree to voluntarily participate in yoga classes, health programs, workshops, and/or other wellness, body-work, therapy, exercise, and healing arts activities (collectively, the “Activities”) offered by Inlet Yoga Studio (the “Studio”). These Activities may take place at the Studio’s physical location, at off-site locations, or be provided digitally through videos, podcasts, apps, or other online platforms. All such offerings, whether in-person or virtual, are collectively referred to as “Activities” in this agreement.

Participant Health and Responsibility

1. Physical Fitness: I acknowledge and accept full responsibility for determining that I am in appropriate physical and mental health to participate in the Activities. I am aware that the Activities may involve intense physical exertion, and I represent and warrant that I am physically fit and have no medical conditions that would inhibit my full participation. It is my responsibility to consult with a physician if necessary before engaging in the Activities. The Studio reserves the right to refuse my participation in any Activity based on health concerns or for any other reason at its discretion.
2. Assumption of Risk: I acknowledge that participating in the Activities involves inherent risks, including but not limited to physical injury, discomfort, and medical complications. I voluntarily assume all risks associated with participation, regardless of whether such risks are caused by my actions or the negligence of the Studio or others.

Medical Authorization and Emergency Contact

1. Medical Emergencies: In the event of a medical emergency, I authorize Inlet Yoga Studio, its representatives, or instructors to seek medical treatment on my behalf if I am unable to do so. I agree to bear any costs associated with such treatment. I will also provide emergency contact information, including the name and phone number of someone to notify in case of emergency.

COVID-19 Specific Clauses

1. Consultation and Risk Factors: If I have any COVID-19 risk factors (as defined by the CDC), I will consult with a physician before participating in Activities at the Studio’s physical location or off-site locations. I understand that participation could expose me to COVID-19, and I voluntarily assume the risk of any resulting illness or death, particularly if I fall within an at-risk category.
2. Assumption of COVID-19 Risk: I acknowledge that despite the Studio’s best efforts to follow public health guidelines, participation in the Activities could expose me to COVID-19. I voluntarily assume full responsibility for any risks, injuries, or damages, including potential death, that I may incur as a result of such exposure.
3. Release of Claims Related to COVID-19: In consideration of being allowed to participate in the Activities, I release and discharge the Studio from any and all claims related to COVID-19 exposure, including illness, injury, or death, regardless of whether caused by negligence on the part of the Studio or its staff.

Participation Limitations and Responsibilities

1. Health Authority Guidelines: I agree to follow all applicable health authority guidelines regarding COVID-19 prevention. I will not attend any Activities within 14 days after returning from a CDC Level 3 Travel Health Notice area, being exposed to someone who has traveled to such areas, or being exposed to anyone with a suspected or confirmed case of COVID-19.
2. Symptom Monitoring and Reporting: I agree not to attend the Studio’s facilities or any off-site Activities if I am experiencing any COVID-19 symptoms, have a suspected or confirmed case, or believe I have been exposed to someone with COVID-19. I will immediately notify the Studio if I am diagnosed with COVID-19 or have been exposed to the virus.

COVID-19 Code of Conduct

1. Acknowledgment of Protocols: I understand and agree to follow the Studio’s COVID-19 Code of Conduct (CCC) and any updated protocols issued by the Studio. I acknowledge that these protocols are designed to mitigate but cannot eliminate the risk of COVID-19 transmission.
2. Waiver of Liability for COVID-19: I acknowledge the risk of exposure to COVID-19 by participating in the Activities, and I assume all responsibility for any consequences, including illness, disability, or death, arising from such participation.

Clause for Off-Site Events

1. Extended Waiver for Off-Site Activities: I understand that the Activities may be offered at off-site locations such as parks, beaches, private homes, or other venues. This Release of Liability extends to any such off-site Activities, and all terms, conditions, and waivers apply equally to those events.

Waiver and Indemnity

1. General Waiver: In further consideration of being permitted to participate in the Activities, I voluntarily and knowingly waive any and all claims (“Claim”) I may have against the Studio, its owners, managers, teachers, instructors, employees, contractors, and agents (collectively, “Released Parties”) that arise from my participation, including claims arising from the negligence of the Released Parties.
2. Indemnity Agreement: I agree to indemnify and hold harmless each Released Party from any loss, cost, or liability, including attorney’s fees, arising from any Claim brought by me or on my behalf, regardless of whether such Claim is based on negligence.
3. Definition of Claim: “Claim” includes, but is not limited to, all liabilities, claims, demands, expenses, legal actions, and rights of action for damages, personal injury, illness, or death that I or my family may suffer, including legal fees, related to participation in the Activities.
4. Photograph and Video Release: I understand that the Studio may photograph or record the Activities for promotional purposes. I consent to the use of my image in any such materials, including the Studio’s website, social media, and marketing platforms.

Waiver of Third-Party Liability

1. No Liability for Third Parties: I agree that the Studio is not responsible or liable for the actions, negligence, or misconduct of third parties, including other participants, vendors, or contractors present at the Studio’s physical location or at off-site events.

Equipment Usage Clause

1. Equipment Use and Responsibility: I acknowledge that the Studio may provide equipment (e.g., yoga mats, blocks, straps) for use during the Activities. I agree to use the equipment responsibly and in accordance with instructions. I assume full responsibility for any injury or damage caused by misuse of the equipment and agree that the Studio is not liable for any such injury or damage.

Limitations on Liability for Property Damage

1. Personal Property: I understand that the Studio is not responsible for the loss, theft, or damage of my personal property while attending Activities, whether at the Studio or at off-site locations.

No Guarantees of Results

1. No Guarantees: I acknowledge that the Studio makes no guarantees or representations regarding specific health or wellness outcomes from participation in the Activities. I understand that individual results may vary and that I am solely responsible for my participation.

Right to Modify or Cancel Activities

1. Cancellation and Modifications: Inlet Yoga Studio reserves the right to modify or cancel any scheduled Activities at any time for any reason. The Studio is not liable for any refund or compensation in the event of cancellation, except as outlined in its cancellation policy.

Governing Law and Severability

1. Jurisdiction: This agreement shall be governed by the laws of the State of New Jersey. Any disputes arising out of or related to this agreement shall be brought exclusively in the courts of Monmouth County, New Jersey.
2. Severability: If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in effect as if the unenforceable provision had never been included.

Acknowledgment

1. Acknowledgment of Understanding: I acknowledge that I have carefully read this Release of Liability, fully understand its contents, and voluntarily agree to its terms. By participating, I waive certain legal rights, including the right to sue the Studio or its representatives.
